A clear agreement for a simple family tool.

These terms describe the rules that apply when you use the TalkSprout iPhone application and public website.

Important purpose

TalkSprout offers general conversation prompts for parents and guardians. It is not professional parenting, medical, mental health, educational, legal, or therapeutic advice, and it is not an emergency service.

1. Agreement to these terms

These Terms of Use are an agreement between you and MN Booth LLC regarding TalkSprout. By downloading, accessing, or using the TalkSprout app or website, you agree to these terms. If you do not agree, do not use TalkSprout.

Apple’s standard terms and any applicable App Store rules also apply to your download and use of the app. If these terms conflict with mandatory App Store terms, the mandatory terms control to the extent of the conflict.

2. Who may use TalkSprout

TalkSprout is designed for adult parents and guardians. You must be legally able to enter this agreement in your location. If a child participates in a conversation prompted by TalkSprout, the parent or guardian remains responsible for deciding whether the prompt and setting are appropriate.

3. Product purpose and judgment

TalkSprout provides curated prompts and, on supported devices, optional on-device prompt variations. Families, children, and circumstances differ. You are responsible for reviewing a question and deciding whether, when, and how to use it.

Do not rely on TalkSprout to diagnose, treat, prevent, or respond to any health, safety, developmental, educational, or family concern. If you believe someone may be in danger or needs professional help, contact an appropriate local emergency service or qualified professional.

You may use TalkSprout for personal and household purposes. You agree not to:

5. Local data and device access

TalkSprout stores profiles, preferences, prompt activity, and related settings locally on your iPhone. You are responsible for controlling access to your device, choosing what information to enter, managing notification preview settings, and maintaining backups you consider appropriate.

Deleting the app or using its reset feature can remove local data. Purchase records may remain with Apple. See the Privacy Policy for more detail.

6. Notifications and availability

iOS controls notification permission, scheduling, focus modes, delivery, and lock-screen presentation. TalkSprout plans local notifications in advance, but it cannot guarantee that a notification will appear at an exact time or in every device state. You should not use TalkSprout notifications for urgent, safety-critical, medical, or time-sensitive purposes.

7. On-device generated content

On compatible devices, TalkSprout may use Apple’s on-device technology to suggest prompt content. Generated content can be incomplete, repetitive, unexpected, or unsuitable. TalkSprout applies local validation and curated fallback behavior, but you remain responsible for reviewing a prompt before using it.

8. Purchases

TalkSprout may offer an optional, one-time non-consumable purchase through the App Store. Available features, localized price, taxes, purchase confirmation, refund eligibility, billing, and family sharing status are shown or handled by Apple. The App Store displays the final localized price and purchase terms before confirmation.

Use Restore Purchases in the app to ask StoreKit to restore an eligible transaction. Refund requests are governed by Apple’s policies and must generally be submitted to Apple. We may change the features included in free or paid tiers for future purchases, but we will not intentionally remove an already verified entitlement without a valid reason.

9. Intellectual property

TalkSprout, including its software, brand, illustrations, interface, prompt library, documentation, and website content, is owned by MN Booth LLC or its licensors and is protected by applicable intellectual property laws. These terms give you a limited, personal, non-exclusive, non-transferable, revocable license to use TalkSprout as provided through the App Store. No ownership rights are transferred to you.

Apple and Apple product names are trademarks of Apple Inc. Other names may belong to their respective owners. No third-party name implies sponsorship unless explicitly stated.

10. Third-party services

TalkSprout relies on Apple platform services for app distribution, purchases, device notifications, and optional on-device intelligence. The website is delivered through Cloudflare. Those services are controlled by their providers and may have separate terms and privacy policies.

11. Changes, interruptions, and termination

We may improve, update, suspend, or discontinue parts of TalkSprout. We may restrict access if we reasonably believe the product is being misused, if required by law, or if needed to protect the product or others. Local core features may continue to work even if a website or external platform service is unavailable, but compatibility can change with hardware or operating-system updates.

12. Disclaimers

To the fullest extent permitted by law, TalkSprout is provided “as is” and “as available.” MN Booth LLC disclaims warranties that are not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that every prompt will be appropriate for every family, that the app will be error-free, or that notifications will always arrive as scheduled.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, MN Booth LLC and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities arising from TalkSprout.

To the fullest extent permitted by law, the total liability of MN Booth LLC for claims relating to TalkSprout will not exceed the greater of the amount you paid for TalkSprout during the twelve months before the claim or fifty US dollars. These limits do not apply where applicable law does not allow them, and they do not limit liability that cannot legally be limited.

14. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold MN Booth LLC harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of TalkSprout or your material violation of these terms. This section does not require you to indemnify MN Booth LLC for its own unlawful conduct.

15. Governing law and disputes

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules, except where the law of your home jurisdiction requires otherwise. Subject to applicable consumer-protection law, disputes that are not resolved informally will be brought in a state or federal court with jurisdiction in Minnesota, and each party consents to that venue.

Before filing a claim, you and MN Booth LLC agree to make a reasonable good-faith effort to resolve the issue informally through the contact method listed on the Support page.

16. General terms

If a provision of these terms is found unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not transfer these terms without our consent, but MN Booth LLC may transfer them as part of a merger, sale, reorganization, or transfer of the TalkSprout business. Headings are for convenience only.

17. Changes to these terms

We may update these terms as TalkSprout changes. The effective date will be revised when new terms are published. If a change materially affects your rights, we will provide notice appropriate to the change. Continued use after revised terms take effect means you accept them, to the extent permitted by law.
